Recent Updates on Leniency Statements and EU FDI Regulations
The Court of Justice of the European Union recently issued a critical ruling concerning the definition of a leniency statement and a settlement submission, and how far the confidentiality protections of a leniency statement extend. Ultimately, this ruling clarified that leniency statements are protected regardless of the transfer of the documents from competition authorities to other authorities such as the public prosecutor’s office. Additionally, the European Commission published its Fifth Annual Report on Foreign Direct Investments (FDI) into the European Union. FDI screening regulations are slated to be updated too.
