New FSR Guidelines, Ongoing FSR Ex-Officio Investigation, and the Draft Code of Practice on Transparency of AI-generated Content
The European Commission (“EC”) published guidelines on the Foreign Subsidies Regulation (“FSR“) with the aim of clarifying its enforcement approach. Relatedly, the EC has announced the initiation of an ex-officio investigation into a Chinese company under the FSR. Separately, the EC released the first draft of the Code of Practice on transparency of AI-generated content which sets out proposed rules on marking, detection, and disclosure of AI-generated/ manipulated content – requirements that will be material for both AI providers and deployers.
